CHAPTER 13

 
 

    Information specific to Chapter 13 cases.

  1. Do not stop making your payments until you have made all of them.  If you think there is a reason to stop before all are made, do not stop until the Trustee or I have told you it is correct to do so.  If you have a plan which is supposed to pay 100 percent of your debts (or close to it) you may not have to make all of the payments if some of your creditors do not file claims.  This happens occasionally.  Sometimes clients look at the Trustee’s reports (which you will receive in the mail) and think they will not have to make all of the payments.  While this may be the case, I have had cases where clients mis-interpreted the report and stopped when they should not have stopped.  If you think you can stop making payments, you can call the Trustee’s office, or my office, to check.  Do not stop unless either the Trustee or I tell you it is all right to do so.

  2. After you have made all of your payments, you have to sign one more form that I have to file with the Court.  Unfortunately, this form cannot be signed ahead of time.  Make sure you keep me updated as to your address and telephone numbers so that I can either have you come in to sign the form or send it to you.

  3. You MUST make your monthly mortgage and car payments if your are keeping a house or a car.  These payments are NEVER in the plan.  The only thing in the plan are arrears on your mortgage, not the regular payments.
